Is it allowed to purchase an Extended license and sell the file within Envato marketplaces. I have a jQuery slider in codecanyon and today someone uploaded the exact same file as wordpress plugin (With exact same thumbnail, description etc) Is this allowed?

If I already knew this is allowed, I would’t opted for Extended licence and now opted out from Extended.

I didn’t think you could.

I thought it was allowed to include a CodeCanyon extended license product in a ThemeForest product, but not within the same marketplace.

If that IS allowed, it shouldn’t be (without the author’s approval).

I think you should contact support.

I had someone contact me about a slider i had for sale and some problems they had in the wordpress plugin they made out of it for CC. I contacted support with the same question and they never really gave me a clear answer. The author eventually switched to using someone elses slider in their product because I didn’t provide them support. I notified support about them now using someone else’s slider in the same manner and do not know what happened after that.

Edit: I just checked and it seems now the author has included multiple sliders from CC in their WP plugin.

Edit edit: and the worst part about that whole situation with me was I was actually working on a WP plugin for my slider. If I would have uploaded it I would more then likely have been rejected because of someone else using MYYYY code in the same fashion.

To me this is the same thing as someone purchasing extended licenses for any of the most popular PHP scripts on the site, doing a little bit of converting to make them work in wordress or some other CMS and re-selling them here. The whole selling point and main functionality of the code is the same regardless of what CMS they work with. I actually thought about trying to do that just to see what would happen. To see whether I would get rejected right on the spot for re-selling someone elses work or they would let me do it.

Yes, my understanding was that the protection was in place for just that reason – so that authors wouldn’t get screwed out of developing different versions of their own products. Just like you can’t take an extended license of an HTML Template on ThemeForest and turn it into a WordPress theme.

In my mind, turning a JS slider into a WordPress slider doesn’t meet the criteria for a “new work” (required by the extended license), since the main code base and function of the work is the same – it’s just in a different wrapper.

But this is one more reason why I opt out of the extended license, just to be safe.

Tricky situation, to be sure. I believe support is on it so it’ll be interesting to get an official response.

Thanks sevenspark, I already reported to support.

I had good number of buyers purchasing extended licenses. But the dilemmas alarming to opt-out to avoid confusions. Btw, I am not even know if the re-producer purchased the Extended, it is frustrating to put time on investigations (within the marketplace) rather than making file! :(

I was all for extended licenses until that situation I mentioned above happened. If I end up uploading more items or attempt to get my items re-enabled(i asked for them to be soft-rejected) then I will more then likely opt out of offering extended licenses anymore.

When I first started uploading to CC I noticed this sort of thing and immediately opted out of extended licensing. It should not be allowed, and the licensing should cover what can and can’t be done within the marketplaces. The best scenario IMO is to only allow extended usage cross-marketplace (graphic river file used in a TF template, etc.)

Copying someone’s thumnail and description is disappointing and hopefully that will get corrected.

I learnt my lesson in a hard way for missing to read threads like this: http://codecanyon.net/forums/thread/extended-license-question/50345

Gray areas are actually black. Now I love freelancing than making micro-stock.

Some moderation on marketplace new files (similar to dedicated forum moderators) could solve most of the gray issues (just the internal files and similarities like file name, description etc – not outside marketplace). The problem with these issues is once a bad habit allowed to exist for a reasonable time, it will just become a trend. Nowadays more number of authors trying to live in the margin of copyright grays rather than investing time on own creations.

I would like to see the items taken down as well. Either that or some type of agreeent asked to be made between the authors of already uploaded items if the license verbiage is updated (like my above suggestion) because I agree with Sevenspark that this interpretation of the extended license shouldn’t qualify.

P.S. We’re talking about an absolute legend here on Envato (VF), and I hope that is taken into account when reviewing this particular situation.
