My email to Vimeo:
Dear Vimeo,
Recently a company named Envato has been talking about copyright policy. They run the world’s largest WordPress theme marketplace ThemeForest, among several other industry leading online stock marketplaces.
http://themeforest.net/In the blog post below, it was suggested not to use Vimeo Video in our products:
http://notes.envato.com/authors/embedding-videos-in-item-previews/But the purpose for using a Vimeo Video is simply to show the customer that we have created an easy way for Vimeo to be embedded. We do this because many customers prefer Vimeo over the alternatives. We always use Vimeo approved embedding methods.
I would like to suggest that allowing this sort of practice is a positive thing for Vimeo. Because premium WordPress themes are big business, and if consumers (who are often novices) aren’t provided with a built-in method to embed Vimeo video, they’re likely to just use other built in methods (YouTube) instead.
As a veteran stock author from the Envato marketplaces, I can tell you that customers want to see Vimeo Video examples in your template/component. Because lots of customers love Vimeo Video. So I think this is a case where allowing Vimeo Video to be embedded in commercial products is a positive thing for everyone involved.
An official response that I can share with others would be great. Thanks for your attention, and regardless of your response, I will always love Vimeo
Sincerely,
Jason McElwaine
Their response:
Hi Jason, Thanks for contacting us and for your enthusiasm with Vimeo! In this particular case, since you’re demonstrating that your themes allow the embedding of videos from Vimeo, we see no problem with including an example video embed with your sample themes. We appreciate you asking us about this usage first. Now go forth and conquer.

screenshot is obviously photoshopped man – no way Vimeo would allow embedding when they provide an embed code
Great job and thanks from the community for helping clear this up – we should have this in the wiki or sticky or something so it’s clear to authors we have permission from them staff.
Awesome job!
Jonathan
So.. Vimeo allows for embedding, YouTube allows for embedding, but there was a discrepancy on whether you’re allowed to embed a video within a template? That’s a ridiculous notion to begin with and I honestly don’t feel there should even be a debate regarding it! If Vimeo doesn’t want their uploads/video player being promoted, so be it then; we’ll just use YouTube.
Just my 2-cents…
